This is a recording of a UKLFI Charitable Trust webinar on The Case Against Israel in the International Court with Natasha Hausdorff, chaired by Daniel Berke that took place on 4 January 2023. On 30 December 2022 the UN General Assembly passed Resolution 77/247 containing a kitchen-sink of allegations against Israel. The Resolution concluded by asking the International Court of Justice (ICJ) to give an “advisory opinion” on loaded questions referring to “ongoing violation by Israel of the right of the Palestinian people to self-determination”, “prolonged occupation, settlement and annexation of the Palestinian territory”, “measures aimed at altering the demographic composition, character and status of the Holy City of Jerusalem”, and “related discriminatory legislation and measures”. The drafters of the Resolution no doubt hoped that the ICJ would advise that the West Bank, including East Jerusalem, and the Gaza Strip are illegally occupied by Israel and that Israel must immediately end any presence there and any control over their borders. The barbaric attacks of 7 October 2023 and the ensuing war have shown that any such advice would be wholly impractical. But will the ICJ give that advice all the same? Adding to the Lawfare, South Africa has launched a contentious case in the International Court of Justice alleging that Israel is committing genocide in Gaza and is seeking a provisional order that Israel cease its military action immediately. Israel's position is that its operation is necessary to prevent genocide by Hamas which has threatened to repeat again and again the massacre, torture and rape committed on 7 October 2023, apparently endorsed by South Africa.
